General Terms and Conditions (GTC)

§ 1 Scope
1.1. These General Terms and Conditions (hereinafter “GTC”) apply to all contracts for the use of the services of poll.graphics (a service of POLLION GmbH, Immanuelkirchstr. 14a, 10405 Berlin, Germany) between POLLION GmbH (hereinafter “Provider” or “we”) and the customer (hereinafter “customer”, “user”, or “you”).
1.2. Conflicting, contrary, or supplementary general terms and conditions of the customer do not form part of the contract unless their validity is expressly agreed in writing.
1.3. These GTC also apply to all future business relationships, even if they are not explicitly agreed again.
§ 2 Subject matter of the contract
2.1. poll.graphics is an online service for visualizing and analyzing constituency data and political polling.
2.2. The Provider makes the following services available to the customer via the website https://poll.graphics:
- Single constituency: access to interactive maps and data for a single constituency
- Constituency package standard: access to several constituencies in one region (e.g. Berlin State Parliament, Baden-Württemberg State Parliament, Rhineland-Palatinate State Parliament, German Bundestag)
- All-Access Germany standard: access to all available constituency maps in Germany (499+ constituencies)
2.3. The services offered may include:
- interactive constituency maps with current polling data,
- data visualization (charts, trends, comparisons),
- regular data updates,
- access to historical data.
2.4. A detailed description of the individual service packages is available on our website.
§ 3 Conclusion of contract and registration
3.1. The presentation of the services on our website does not constitute a legally binding offer, but an invitation to place an order.
3.2. By clicking the “Buy now” or “Complete subscription” button, you submit a binding offer to enter into a subscription agreement.
3.3. After submitting the order, you will be redirected to our payment service provider Stripe to complete the purchase.
3.4. The contract is concluded when:
- the payment is successfully processed, and
- you receive a confirmation email, and
- your user account is activated with the corresponding access rights.
3.5. Registration is required when concluding a subscription. The following information must be provided:
- email address (mandatory),
- username (automatically generated or selected by the user),
- password (automatically generated or selected by the user),
- billing address (name, address, company, if applicable).
3.6. The customer undertakes to provide truthful and complete information during registration and to update it promptly in the event of changes.
3.7. By registering, the customer declares that they agree to these GTC, the Privacy Policy, the Terms of Use, and the waiver of the right of withdrawal.
§ 4 Prices and payment terms
4.1. The prices stated on the website at the time of ordering apply. All prices include statutory VAT.
4.2. Payment is processed via our payment service provider Stripe (Stripe Payments Europe, Ltd., Dublin, Ireland). The following payment methods are accepted:
- credit card (Visa, Mastercard, American Express)
- debit card
- SEPA direct debit
- other payment methods supported by Stripe
4.3. For monthly subscriptions, billing occurs on the day the contract is concluded (billing date, due date) and then monthly on the same day.
4.4. For annual subscriptions, billing occurs on the day the contract is concluded (billing date, due date) and then annually on the same day.
4.5. The customer receives an invoice by email for each successful payment.
4.6. Promotion codes: Discount codes offered by us apply for the specified number of billing periods. Example: A fixed discount of €2 for “3 months” means: with monthly billing, 3 consecutive months are discounted (3 × €2 discount), while with annual billing only the first billing period is discounted (1 × €2 discount). This is a technical limitation of Stripe.
4.7. In the event of non-payment, we reserve the right to suspend access immediately until any outstanding amounts are settled. If payment is more than 14 days overdue and after a payment reminder, we reserve the right to permanently suspend access until the outstanding amounts are paid.
§ 5 Term and termination
5.1. Monthly subscriptions:
- Term: 1 month, automatically renewed by 1 month each time
- Notice period: 1 week before the end of the current billing period
- Termination: via your user account or by email to poll.graphics@pollion.com
5.2. Annual subscriptions:
- Term: 12 months, automatically renewed by 12 months each time
- Notice period: 1 week before the end of the current billing period
- Termination: via your user account or by email to poll.graphics@pollion.com
5.3. After termination, your access remains active until the end of the paid period. No partial refund of payments already made is granted.
5.4. After the subscription expires, your access data and personal data will be stored in accordance with our Privacy Policy (365-day retention period, followed by automatic deletion), unless there is a legal obligation to retain them.
5.5. The right to extraordinary termination for cause remains unaffected.
§ 6 Right of withdrawal for consumers

Right of withdrawal
You have the right to withdraw from this contract within fourteen days without giving reasons.
The withdrawal period is fourteen days from the date of contract conclusion.
To exercise your right of withdrawal, you must notify us (POLLION GmbH, Immanuelkirchstr. 14a, 10405 Berlin, Germany, email: poll.graphics@pollion.com) of your decision to withdraw from this contract by means of an unambiguous statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, although this is not mandatory.
To comply with the withdrawal deadline, it is sufficient that you send the notice exercising the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, we will refund to you all payments we have received from you, including delivery costs (except for additional costs arising from your choice of a different type of delivery than the cheapest standard delivery offered by us), without undue delay and no later than fourteen days from the day on which we received the notice of withdrawal of this contract. We will use the same payment method that you used for the original transaction unless you have expressly agreed otherwise; under no circumstances will you be charged any fees for this refund.
Early expiry of the right of withdrawal
The right of withdrawal expires early for a contract for the provision of services if the entrepreneur has fully performed the service and began performing it only after the consumer gave their explicit consent and simultaneously confirmed that they were aware that they would lose their right of withdrawal once the service had been fully performed.
Your consent to immediate access:
By clicking the “Buy now” or “Complete subscription” button and confirming the checkbox “I agree that the service will be provided immediately after conclusion of the contract and acknowledge that I will lose my right of withdrawal as a result”, you explicitly agree that we will grant you immediate access to the purchased content after receipt of payment.
You explicitly confirm that you have taken note of the fact that your right of withdrawal expires upon full provision of access.
§ 7 Usage rights and copyright
7.1. All content provided on poll.graphics (maps, graphics, data, analyses, texts, software) is protected by copyright and is owned by POLLION GmbH or its licensors.
7.2. Upon concluding a subscription, you receive a simple, non-exclusive, non-transferable right of use for the duration of the subscription.
7.3. Permitted use:
- display and use of maps and data within the scope of your professional or private activity, with attribution to poll.graphics and source references,
- export of graphics (PNG, SVG, PDF) for presentations, reports, articles, and studies with attribution to poll.graphics and source references,
- commercial use of exported graphics (e.g. in newspaper articles, studies) with attribution to poll.graphics and source references.
7.4. Prohibited use:
- resale or transfer of access or content to third parties,
- reverse engineering, decompilation, or disassembly of the software,
- removal of copyright notices or watermarks,
- automated scraping or mass retrieval of data (without written permission),
- use of data to create competing products,
- white-label use without a separate licensing agreement.
7.5. In the event of violations of these usage rights, we reserve the right to terminate your subscription immediately and assert claims for damages.

§ 8 Availability and technical requirements
8.1. We make every effort to provide the highest possible availability of our services, but we cannot guarantee 100% availability.
8.2. We will notify you in advance by email if possible at least 48 hours before scheduled maintenance work and, if possible, avoid performing maintenance during peak usage times.
8.3. Technical requirements:
- internet access with at least 2 Mbit/s,
- current web browser (Chrome, Firefox, Safari, Edge in current version),
- cookies and JavaScript enabled,
- screen resolution of at least 1024×768 pixels.
8.4. The customer is responsible for providing these technical requirements.
§ 9 Data protection
9.1. We process your personal data in accordance with the provisions of the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG).

§ 10 Liability
10.1. We are liable without limitation for damages arising from injury to life, body, or health if the breach of duty is based on an intentional or negligent act by us, our legal representatives, or vicarious agents.
10.2. We are also liable without limitation for other damages caused by intentional or grossly negligent breach of duty by us, our legal representatives, or vicarious agents.
10.3. Otherwise, we are liable only for breach of essential contractual obligations (cardinal obligations). In such cases, liability is limited to the typical contractual damages that were foreseeable. Cardinal obligations are those duties without which the proper performance of the contract would not be possible and on which the contracting party may reasonably rely.
10.4. We assume no liability for the accuracy, completeness, or timeliness of the analyses provided on poll.graphics. The data comes from publicly available sources and is prepared to the best of our knowledge and belief, but may contain errors or inaccuracies.
10.5. Liability under the German Product Liability Act remains unaffected.
§ 11 Changes to the GTC
11.1. We reserve the right to amend these GTC with effect for the future if necessary (e.g. due to changes in legal requirements, scope of services, or prices).
11.2. You will be informed of changes by email at least 4 weeks before they take effect.
11.3. If you do not object to the amendments within 4 weeks after receiving the amendment notice, the amendments are deemed accepted. We will separately notify you of this objection right and the significance of the deadline in the amendment notice.
11.4. In the event of an objection, both parties have the right to terminate the contractual relationship extraordinary as of the effective date of the amendments.
§ 12 Final provisions
12.1. Applicable law: The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).
12.2. Place of jurisdiction: If the customer is a merchant, a legal entity under public law, or a special fund under public law, the exclusive place of jurisdiction for all disputes arising from this contract is Berlin, Germany.
12.3. Severability clause: If individual provisions of these GTC are invalid or unenforceable, the validity of the remaining provisions remains unaffected. In place of the invalid or unenforceable provision, the effective provision that most closely matches the economic purpose of the invalid provision will apply.
12.4. Dispute resolution: We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
